Please read these terms carefully before using our website or making a purchase. By placing an order with Curve Couture, you confirm that you have read, understood, and agreed to these Terms.
1. About Us
Curve Couture is operated by CURVE COUTURE, NZBN 9429052106996, based in Auckland, New Zealand. You can contact us at hello@curvecouture.co.nz.
2. Introduction
By accessing the Curve Couture website (curvecouture.nz) or purchasing our products, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Returns & Exchanges Policy.
We may update these Terms from time to time. Non-material changes take effect when posted on this page. For material changes, we will take reasonable steps to notify you, for example by email or a notice on our website. Your continued use of the site or purchase of our products after changes are posted constitutes acceptance of the updated Terms.
3. Consumer Rights (Consumer Guarantees Act 1993 and Fair Trading Act 1986)
Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where you purchase goods for business purposes, you agree that the Consumer Guarantees Act does not apply to that purchase.
Product descriptions. We strive to provide accurate product descriptions, measurements, and imagery. Minor variations in colour, fabric finish, or fit may occur due to screen display differences, lighting, or production batches. These variations are not considered faults.
Sizing and fit. Shapewear is a compression garment and sizing is inherently personal. We provide detailed size guides for every product and encourage you to check these before ordering. An item that does not fit as expected is a change of mind return and is subject to our Returns & Exchanges Policy, not a fault under the Consumer Guarantees Act.
Ordering and payment. All orders are subject to acceptance and availability. Prices are in New Zealand Dollars (NZD) and include GST where applicable. Full payment is required at time of ordering.
Delivery. We aim to dispatch within the timeframe shown at checkout. Delivery times are estimates only. We are not liable for delays caused by couriers, customs, or circumstances outside our reasonable control.
4. Returns and Exchanges
Returns and exchanges are governed by our separate Returns & Exchanges Policy, which forms part of these Terms.
Faulty items are always covered under the Consumer Guarantees Act 1993. For hygiene reasons, shapewear, bodysuits, and other intimate apparel cannot be returned for change of mind once the item has been worn, washed, or altered in any way. Please read the full Returns & Exchanges Policy before purchasing.
5. Final Sale Items
Items marked as Final Sale, Founder's Collection, or sold at a discount of 40% or more are not eligible for change of mind returns or exchanges. Your rights under the Consumer Guarantees Act 1993 for faulty goods are not affected.
6. Pre-Orders and Backorders
Where a product is available for pre-order or backorder, the estimated dispatch date will be shown at checkout. Pre-order dates are estimates and may change. You may cancel a pre-order for a full refund at any time before the item is dispatched.
7. Promotions, Discounts, and Gift Cards
Promo codes and discounts are subject to the terms stated at the time of the offer. Unless otherwise specified, codes cannot be combined with other offers, are not redeemable for cash, and may be withdrawn at any time. Gift cards are non-refundable, non-transferable, and expire in accordance with the terms provided at purchase.
8. Intellectual Property
All content on the Curve Couture website, including text, graphics, logos, product imagery, packaging design, and software, is the property of Curve Couture or its licensors and is protected under New Zealand and international copyright law. You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written permission.
9. Customer Accounts and Acceptable Use
If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for all activity on your account. You agree not to use our website for any unlawful purpose, to attempt to breach its security, or to interfere with its operation. We may suspend or terminate accounts that breach these Terms.
10. Limitation of Liability
To the fullest extent permitted by New Zealand law, Curve Couture is not liable for any indirect, incidental, or consequential loss arising from the use of our website or products. Our total liability to you for any claim is limited to the purchase price of the relevant product. Nothing in this clause limits your rights under the Consumer Guarantees Act 1993.
11. Refusal and Cancellation of Orders
We reserve the right to refuse or cancel any order at our discretion, including where a product is listed at an incorrect price, is out of stock, or where we suspect fraudulent activity. If we cancel an order, we will notify you using the contact details provided and issue a full refund promptly.
12. Pricing and Errors
In the event a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any orders placed at that price and notify affected customers. We reserve the right to adjust pricing at any time. Prices at the time of order confirmation are the prices that apply to your purchase.
13. International Orders
Where we ship outside New Zealand, the customer is responsible for any import duties, taxes, or customs fees imposed by the destination country. We are not liable for parcels held, delayed, or returned by customs.
14. Force Majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including natural disasters, pandemics, strikes, courier failures, supplier failures, or government restrictions.
15. Dispute Resolution
If you have a concern with your order or our service, please contact us first at hello@curvecouture.co.nz so we can work to resolve it. If we cannot resolve the matter directly, you may refer the dispute to the New Zealand Disputes Tribunal or another appropriate body.
16. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full effect. These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
